Privacy Policy

BY ACCESSING OR USING THE SITE, YOU AGREE THAT YOU HAVE READ AND UNDERSTOOD, AND, AS A CONDITION TO YOUR USE OF THE SITE, YOU AGREE TO BE BOUND BY, THE FOLLOWING TERMS AND CONDITIONS, INCLUDING MED RMS PRIVACY POLICY (TOGETHER, THESE “TERMS”). IF YOU ARE NOT ELIGIBLE, OR DO NOT AGREE TO THE TERMS, THEN YOU DO NOT HAVE OUR PERMISSION TO USE THE SITE. YOUR USE OF THE SITE, AND MED RM’S PROVISION OF THE SITE TO YOU, CONSTITUTES AN AGREEMENT BY MED RM AND BY YOU TO BE BOUND BY THESE TERMS.

ARBITRATION NOTICE. Except for certain kinds of disputes described in Section 18, you agree that disputes arising under these Terms will be resolved by binding, individual arbitration, and BY ACCEPTING THESE TERMS, YOU AND MED RM ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN ANY CLASS ACTION OR REPRESENTATIVE PROCEEDING. YOU AGREE TO GIVE UP YOUR RIGHT TO GO TO COURT to assert or defend your rights under this contract.

1. USE OF THE SITE. MED RM operates the website located at www.medrm.online and other related websites and mobile applications with links to these Terms of Use (collectively, the “Site”). We offer online services related to pet health (the “Services”) including services using digital interactive audio and video technology (including but not limited to text messaging, online chat, and digital video conferencing) enabling our users (“Users”) to report the health history of their pets and engage veterinary professionals (“Providers”) to obtain veterinary services. You have requested access to our Site in the capacity of a Provider. By accessing and using the Site, you agree to be bound by these Terms of Use and all other terms and policies that appear on the Site. If you do not wish to be bound by any of these Terms of Use, you may not use the Site or the Services. If you are entering into these Terms of Use on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these Terms of Use, in which case the terms “you” or “your” will refer to such entity. If you do not have such authority, you must not accept these Terms of Use or use the Site or the Services on such entity’s behalf.

MED RM and those acting on our behalf may send you text (SMS) messages at the phone number you provide us. These messages may include operational messages about your use of the Site. You may opt out of receiving operational text messages at any time by sending an email to kripty@proton.me indicating that you no longer wish to receive such texts along with the phone number of the mobile device receiving the texts.  You may continue to receive text messages for a short period while MED RM processes your request, and you may also receive text messages confirming the receipt of your opt-out request.  Opting out of receiving operational text messages may impact the functionality that the Site provides to you. Text messages may be sent using an automatic telephone dialing system. Your agreement to receive text messages is not a condition of any purchase or use of the Site. Standard data and message rates may apply whenever you send or receive such messages, as specified by your carrier.

We may send you emails concerning out products and services, as well as those of third parties. You may opt out of promotional emails by following the unsubscribe instructions in the promotional email itself.

VETERINARY MEDICINE SERVICES. If you are agreeing to these Terms as a veterinarian, you acknowledge that you hold a current and valid license to practice veterinary medicine in your country of residence, and are in good standing in all jurisdictions in which you will provide services through the Site. If you are agreeing to these terms as a veterinary technician, you acknowledge that you hold a current and valid license to veterinary technician services in your country of residence, and are in good standing in all jurisdictions in which you will provide services through the Site.  You acknowledge that you are solely responsible for the services you provide to Users and their pets. MED RM does not practice veterinary medicine, veterinary technician services, or any other licensed profession, and does not interfere with the practice of veterinary medicine, veterinary technician services, or any other licensed profession by Providers, each of whom is responsible for his or her services and compliance with the requirements applicable to his or her profession and license. Neither MED RM nor any third parties who promote the Services or provide Users with a link to the Site shall be liable for any professional advice Users or their pets obtain from a Provider via the Services.

Veterinarians

You shall only diagnose, treat, or prescribe medication to a User with respect to their pet (the “VCPR Services”) if you have established a valid Veterinarian-Client-Patient Relationship (“VCPR”) under applicable law for the specific pet that is the subject of the VCPR Services. The requirements of a valid VCPR may vary jurisdiction to jurisdiction. The VCPR for the specific pet that is the subject of the Services must have been established within a reasonable time considering the specific condition of the pet but in no case more than a year prior to your provision of VCPR Services to the User on the Site. If you have not established a valid VCPR, you agree that you shall not provide any services that require a VCPR.

 Accounts and Security

To access and use certain features of the Services, you might need to register for an account (“Account”) by creating a password and providing your name, email address, phone number and other information. If you register for an Account, you must provide accurate information and promptly update this information if it changes. You also must maintain the security of your Account and promptly notify us if you discover or suspect that someone has accessed your Account without your permission. If you permit others to use your Account credentials, you are responsible for the activities of such users that occur in connection with your Account. For example, if you are a parent or guardian that provides consent to your teenager’s use of the Services through your Account, you agree to be bound by these Terms in respect of such teenager’s use of the Services.

Additional Terms Associated with Remote Visits

All health professionals performing licensed clinical services on the Services hold the professional licenses issued by the professional licensing boards or agencies in the states where they practice. All physicians, psychologists, and nurse practitioners hold advanced degrees and have undergone postgraduate training. You can report a complaint relating to the care provided by a health care professional by contacting the professional licensing board in the state where the care was received. In a professional relationship, sexual intimacy is never appropriate and should be reported to the board or agency that licenses, registers, or certifies the licensee.
